Taxation of income affects millions of people from all walks of life, including senior citizens. For individuals over the age of 60, retirement may bring an end to their official duties, but not necessarily to taxes. The income that you earn through your pension, rent, interest on fixed deposit, investments or any part-time hustle is considered to be a part of your income and thus is taxable.
The way taxation works for regular taxpayers differs from that for seniors, as the Union Government brings several policies that favour seniors. Understanding these tax exemptions and obligations can feel confusing, but with digital solutions like the JioFinance app, filing an Income Tax Return (ITR) can be much simpler than many retirees expect. Let’s begin.
Contrary to popular belief, turning 60 does not automatically exempt you from filing an income tax return. However, age alone does not determine whether you need to file a return. The requirement to file an ITR depends primarily on your income, the tax regime you choose, and your overall eligibility under the Income Tax Act. If your total income exceeds the basic exemption limit, then yes, filing an ITR is mandatory for you.
Keep in mind that ITR for senior citizens is more than just paying taxes. The benefits go beyond; here’s how:
Section 194P of the Income Tax Act is a special provision for citizens aged 75 years and above. Under this section, eligible senior citizens do not need to file an income tax return if their tax is correctly deducted by the bank that pays their pension.
You don't need to file an ITR if you:
Once you make the declaration, your bank will calculate the total taxable income after considering eligible deductions and rebates. It then deducts the applicable tax through TDS.
Note: Under the Income Tax Act 2025, which came into effect from April 1, 2026, TDS deduction for different kinds of transactions will be consolidated under Section 393.
In India, everyone over the age of 60 is regarded as a senior citizen. The Government of India offers enhanced benefits to people aged 80 and over, known as super senior citizens. The tables below show the income tax slabs for seniors as per the old tax regime.
| Yearly Income | Tax Rate |
| Up to ₹3,00,000 | Nil |
| ₹3,00,001 – ₹5,00,000 | 5% |
| ₹5,00,001 – ₹10,00,000 | 20% |
| Above ₹10,00,000 | 30% |
| Yearly Income | Tax Rate |
| Up to ₹5,00,000 | Nil |
| ₹5,00,001 – ₹10,00,000 | 20% |
| Above ₹10,00,000 | 30% |
If you choose the new regime, keep in mind that the same tax slabs apply to all individual taxpayers.
| Yearly Income | Tax Rate |
| Up to ₹4,00,000 | Nil |
| ₹4,00,001 – ₹8,00,000 | 5% |
| ₹8,00,001 – ₹12,00,000 | 10% |
| ₹12,00,001 – ₹16,00,000 | 15% |
| ₹16,00,001 – ₹20,00,000 | 20% |
| ₹20,00,001 – ₹24,00,000 | 25% |
| Above ₹24,00,000 | 30% |
Often, retirees choose a tax regime without comparing benefits. Reviewing both tax regimes before filing could reduce your tax liability. If you have investments or certain insurance policies in your name, certain sections of the Income Tax Act offer you tax exemptions. However, keep in mind that tax exemptions are available only when you opt for the old tax regime.
| Section | Deductions |
| Section 80C (Section 123 as per the Income Tax Act 2025) | This section allows tax benefits of up to ₹1,50,000 towards the premiums paid for investments and life insurance policies. Some common examples are the Public Provident Fund, the Sukanya Samridhi Yojana, the Senior Citizen Savings Scheme, and the National Pension Scheme. |
| Section 80TTB | A deduction of ₹50,000 is available on the interest that is earned on FDs, RDs and savings accounts. |
| Section 80D (Section 126 as per the Income Tax Act 2025) | Seniors can avail a tax exemption of up to ₹50,000 towards the health insurance premium that they pay. If you are paying health insurance premiums for your parents, who are also seniors, you can avail the benefits of up to ₹1,00,000. If you do not have health insurance, in case of any medical expenses, you would be eligible to claim the same amount. |
| Section 80DDB | Treatments of illnesses such as cancer, neurological diseases, AIDS, etc., can get you a tax exemption of up to ₹1,00,000. |
Remember: The new tax regime is the default regime. This means that if you do not choose a tax regime during the senior citizen ITR filing, then you will be taxed as per the new regime.
When you choose the new tax regime, you can avail the Section 87A rebate, which may reduce your tax liability. If your income is less than ₹12,00,000, you can avail a deduction of ₹60,000. If you choose the old tax regime, then you can qualify for a tax rebate of ₹12,500.
A standard deduction of ₹50,000 and ₹75,000 under the old and new tax regimes, respectively, is available for seniors as well as super senior citizens.
Let us break down the senior citizen ITR filing process to make it simpler and less intimidating.
The documents include:
Before filing your return, visit the Income Tax portal, log in using your PAN/ Aadhar Card. Keep your registered mobile handy to validate the process. Then cross-check your income and tax details with the information available on the Income Tax portal. Review Form 26AS, Annual Information Statement (AIS) and TDS records.
Note: Under the Income Tax Act, 2025, Form 168 will serve as a comprehensive annual tax information statement. It will reflect all tax-related and specified financial transactions associated with a taxpayer's PAN.
Pensioners with straightforward income sources may generally use ITR-1, while those with capital gains, multiple properties, or other specified income sources may need a different form.
Do this step carefully. Take your time and calculate your income from pension, rent, interest earned, capital gains, etc. Remember, reporting all income sources accurately can help avoid notices and discrepancies later.
As discussed earlier, your tax exemptions depend largely on the tax regime you choose.
Once all details have been reviewed, submit your return and complete the verification process.
