Every year, without fail, the same panic sets in around July. Inboxes flood with tax reminders, colleagues start comparing refund amounts, and somewhere in the middle of all this, you realise your employer hasn't sent Form 16 yet. Or maybe the company shut down, or you switched jobs. Maybe nobody deducted TDS at all. Whatever the reason, the result feels the same: stuck.
But here's what most people don't know. Form 16 is convenient, not compulsory. You can file a perfectly valid ITR without Form 16, and the Income Tax Department won't penalise you just for not having one. What matters is that your income and taxes are reported correctly.
Under recent amendments, the Income Tax Act of 1961 has been fully replaced by the Income Tax Act of 2025. Worry not; the new rules will be applicable from FY 2026-27, so for the current year, you can still rely on the earlier forms and procedures.
Few Changes to Note:
Think of Form 16 as a summary your employer prepares on your behalf. It lists your salary, any exemptions you claimed through them (like HRA), deductions under Chapter VI-A, and the TDS they cut and deposited with the government. Employers are supposed to issue it by 15th June every year.
The problem is, not every situation fits neatly into that process. If you changed jobs mid-year, your previous employer may only issue Form 16 for the months you worked there, and your new one might not issue one at all if you joined late. Some smaller companies don't deduct TDS if your declared income falls below the exemption threshold. And sometimes, employers are just late or non-compliant.
None of this is your fault. But the ITR deadline doesn't wait for anyone, so let's talk about what you actually need. Read on to understand ‘how to file ITR without Form 16’.
You don't need Form 16 if you have the right alternatives. Here's a list of documents that you actually need to file an income tax return:
Dig out every month's salary slip that is sitting in your email somewhere. They carry your gross salary, basic pay, HRA, allowances, PF contributions, and professional tax, essentially everything Form 16 Part B would have shown you.
This is downloadable from the Income Tax e-filing portal and is more useful than Form 16 in some ways. It shows every rupee of TDS deducted against your PAN, across all employers and income sources.
The statement is available on the Income Tax portal. It's a broader picture that includes interest from FDs, dividends, capital gains, rent received, and more. Cross-check this carefully. If you upload your AIS on the JioFinance app, the app will auto-fill the details, saving you time and effort.
Bank statements are useful for verifying salary credits, interest income, or any unexplained credits that may need to be declared.
LIC and ELSS statements for 80C, rent receipts for HRA, health insurance premium certificates for 80D, NPS contribution slips, and so on have to be declared. Collect proof of your investments and deductions.
Once these are in hand, you're not really missing Form 16. You're just doing the compilation yourself instead of relying on your employer to do it. With these documents, you can file ITR without Form 16.
Start by adding up your income from all sources. Salary is the big one, but don't ignore FD interest, rental income, or any capital gains from mutual funds or stocks sold during the year. Many people forget these, and it's the kind of thing AIS will flag.
Then figure out your deductions. HRA, 80C investments, health insurance, loan interest, whatever applies to you. This step matters because it directly changes your taxable income.
Here's where things used to get complicated: choosing between the old and new tax regimes. The new regime offers lower rates but fewer deductions. The old one lets you claim more but has higher slabs. For most people, the right answer depends entirely on their individual numbers.
Filing an ITR on your own can be a daunting task. It involves multiple calculations and proper formatting. That's exactly the kind of calculation the JioFinance app handles well. Here's how:
The first step is to calculate the tax you owe to the income tax department. You can easily calculate it using the ‘Tax Planning’ tool in the JioFinance application. Open the tool, enter your income and deductions, and it computes your liability under both regimes side by side. No manual slab-matching, no second-guessing. You see the numbers, you pick the better option, and you move on.
The final step is to file the ITR. Simply use the ‘Tax Filing’ tool in the JioFinance application and itr filing without any hassle. You may file it by yourself (DIY Filing) or let the app do it for you (Assistive Filing). Throughout the process, the Tax Buddy will assist you for a hassle-free experience.
Note: Verify the figures against your own documents, make corrections where needed, and submit. Just make sure you e-verify within 30 days, or the filing won't count.
Filing ITR without Form 16 means you're doing more of the groundwork yourself. It involves gathering figures, reconciling TDS, and computing income from multiple sources. It's manageable, but it's also where small errors tend to creep in.
The JioFinance app and the Jio Finance Services portal are genuinely useful here, not just for the Tax Calculator but for the broader picture it gives you of your finances. If you're someone with income from more than one source, say, a salary plus some freelance work or rental income, the smart tools by JFSL help you get everything in order before you start filing.
And the regime comparison alone is worth it. A lot of people pick old vs new based on gut feeling and end up overpaying. The calculator removes that guesswork entirely.
Did you know? JioFinance sends you timely notifications and reminders regarding ITR so you don't miss deadlines.
Not having Form 16 (Form No. 130 as per Income Tax Act 2025) is an inconvenience, not a roadblock. You can still file ITR without Form 16. Your salary slips, Form 26AS, AIS, and a few investment documents carry all the information you need to file a clean, accurate return. Jio Financial Services Limited takes much of the manual effort out of the process, whether you're a salaried employee, a freelancer, or someone with income across multiple heads.
File on time, verify your return, and you're done.
